Federal Magistrate Judge Allows Portion of Expert's Supplemental Report

OKLAHOMA CITY - In a Paxil injury case, an Oklahoma federal magistrate judge has granted plaintiffs' motion for leave to file a supplemental expert report, but only to the extent that it relies upon materials that were cited in the text of the expert's original report. Hayes v. GlaxoSmithKline, No. 07-0682 (E.D. Okla.).

On Oct. 22, Magistrate Judge T. Lane Wilson of the U.S. District Court for the Eastern District of Oklahoma denied the motion as to "new and additional opinions" not disclosed in the initial report which attempt to "strengthen" and/or "deepen" the opinions expressed in the original report.
