Rust-Oleum Moves for Sanctions in Benzene Case, Cites Deficient Interrogatory Responses

BALTIMORE -- Defendant Rust-Oleum has moved for a sanctions order, claiming that the plaintiffs failed to properly respond to the benzene defendant's interrogatories and request for production of documents. Bailey, et al. v. BWD Automotive Corp., et al., No. WDQ-04-2078 (D. Md.).
According to the April 21 motion in the U.S. District Court for the District of Maryland, the plaintiffs instead responded to the request with 'untimely, unverified, incomplete and evasive answers.'
Rust-Oleum contends that when receiving the deficient responses, it requested supplemental responses of the plaintiffs. The plaintiffs did not respond, the motion says.
