BALTIMORE — Smith & Nephew Inc. argues that a BHR hip plaintiff’s case should not be reinstated because he continually failed to timely provide a complete plaintiff’s fact sheet, prejudicing the manufacturer and wasting the court’s time and resources.

In an Oct. 23 opposition filed in the U.S. District Court for the District of Maryland, Smith & Nephew argues that the plaintiff has failed to explain how he failed to comply with the court’s orders in providing a substantially complete PFS.
