Miss. Court Grants Unopposed Motion to Dismiss in Asbestos Case, Allows Plaintiffs to Amend

JACKSON, Miss. –– A Mississippi federal court has granted an asbestos defendant’s unopposed motion to dismiss, finding that the plaintiff had not made a plausible claim against the company to overcome its affirmative “innocent seller” defense.

In the Feb. 11 decision, the U.S. District Court for the Southern District of Mississippi did allow the plaintiffs 14 days from the date of the order to file a motion for leave to file an amended complaint.
