Fla. Federal Judge Remands NuVasive Spinal System Case

MIAMI — A Florida federal judge has remanded an action involving NuVasive Inc.’s SpheRx spinal system, ruling that the defendant failed to prove that the amount in controversy exceeds $75,000.
In a Jan. 22 order, Judge Robert N. Scola Jr. of the U.S. District Court for the Southern District of Florida said the amount of damages sought by the plaintiff cannot be determined from the face of the complaint.
Karen Shapiro underwent spinal surgery in July 2010 during which her surgeon used the NuVasive SpheRx DBR II Spinal System and inserted a number of polyaxial screws into her spine.
