Benzene Plaintiffs Re-File Complaint in N.C. Court After Pa. Court Dismissed Case on Forum Grounds

CHARLOTTE, N.C. –– Benzene plaintiffs have re-filed their action in a North Carolina federal court after a Pennsylvania state court dismissed their claims on forum non conveniens grounds, arguing that a former employee of Duke Energy Corp. developed MDS as a result of exposure to benzene-containing products.

In the Nov. 2 complaint filed in the U.S. District Court for the Western District of North Carolina, the plaintiffs stated that the exposure happened in North Carolina and, therefore, personal jurisdiction exists.
