Biomet M2a Plaintiff Must File Brief Supporting Assertion that Case Belongs in N.Y. Federal Court

SOUTH BEND, Ind. — The Indiana federal judge overseeing the Biomet M2a Magnum hip implant multidistrict litigation docket has ordered a plaintiff to file a brief in support of his assertion that his case should be tried in the Western District of New York.

In an Oct. 15 order, Judge Robert L. Miller Jr. of the U.S. District Court for the Northern District of Indiana said Texas resident Michael Giambruno has until Oct. 26 to submit his arguments, and Biomet has until Nov. 9 to respond.
