N.Y. Federal Judge Dismisses Suboxone Overdose Action as Time-Barred

SYRACUSE, N.Y. — A New York federal judge has dismissed a Suboxone death action as time-barred, ruling that the plaintiffs failed to serve their lawsuit within three years of their son’s fatal heroin overdose, as required under Connecticut law.

On Aug. 9, Judge Brenda K. Sannes of the U.S. District Court for the Northern District of New York explained that under Connecticut’s three-year statute of limitations, the plaintiffs needed to serve the defendants by Dec. 27, 2016, but waited until February 2017 to do so.
