Design Defect, Warning Claims to Proceed in Boston Scientific Transvaginal Mesh Cases

CHARLESTON, W. Va. — A West Virginia federal judge has denied Boston Scientific Corp.’s motions for summary judgment on design defect and failure-to-warn claims in two cases involving its Obtryx and Solyx transvaginal mesh devices.

In orders issued July 27, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia found issues of fact exist as to whether the devices were defectively designed and accompanied by inadequate warnings, and whether the plaintiffs’ injuries were caused by such deficiencies.
