North Carolina Court Grants Motion to Strike Report, Testing in Asbestos Talc Case

GREENSBORO, N.C. –– A North Carolina federal court has granted a motion to strike a report and testing from a plaintiff expert in an asbestos talcum powder action, saying the plaintiff failed to disclose the expert, or his testing, in accordance with Rule 26 standards.

In the June 8 opinion, the U.S. District Court for the Middle District of North Carolina found that the failure to disclose the expert and his testing had “significant” repercussions on Pfizer since the defendant could not depose the expert or perform its own testing.
