Common Benefit Fund Assessment Reduced for Mediation Claimants in Durom Hip Cup MDL

TRENTON, N.J. — A New Jersey judge has reduced the common benefit fund assessment from 4 percent to 1 percent as to four claimants who never actually filed suit in the Zimmer Durom Hip Cup multidistrict litigation but did participate in mediation.

In the May 17 order, Judge Susan Wigenton of the U.S. District Court for the District of New Jersey explained that a reduction is warranted because while each of the plaintiffs participated in court-mandated mediation, at no time did they initiate litigation in any court.
