Manufacturing Defect, Fraud Claims to Proceed in Wright Profemur Hip Case

PINE BLUFF, Ark. — An Arkansas federal judge has refused to dismiss claims of manufacturing defect, fraudulent misrepresentation and punitive damages against Wright Medical Technology Inc. (WMT) in a Profemur metal-on-metal hip case, finding they were sufficiently pled.

However, in the March 30 order, Judge Kristine G. Baker of the U.S. District Court for the Eastern District of Arkansas dismissed the claims against WMT’s parent company, Wright Medical Technology, for lack of personal jurisdiction, finding the company did not design, market or advertise the device in Arkansas, or any other state.
