Missouri Court Remands Roundup Suit, Says Monsanto Engaged in ‘Procedural Gamesmanship’ by Removing Claims

ST. LOUIS –– A Missouri federal court has granted a Roundup plaintiff’s motion to remand, opining that the defendant engaged in “procedural gamesmanship” when removing the case before the plaintiff had sufficient time to serve Monsanto.

In the Jan. 19 order, the U.S. District Court for the Eastern District of Missouri found that Monsanto “clearly” did not allow the plaintiff enough time to serve the company when it removed the case 15 days after the complaint was filed.
