Utah Federal Judge Dismisses Non-Insurer Defendants From Professional Liability Coverage Action

SALT LAKE CITY — A Utah federal judge has dismissed claims asserted against XL Group Ltd. and certain of its member insurers in a dispute over coverage for investment losses, ruling that the court lacks specific personal jurisdiction because those defendants did not issue the policy, or administer the policy.

In a Dec. 19 order, Judge Dale A. Kimball of the U.S. District Court for the District of Utah found the action does not arise out of activities allegedly directed at Utah by the non-insurer XL defendants and, as such, the claims against those defendants must be dismissed.
