Defendants Ask Pinnacle MDL Judge to Exclude Opinions of Dr. Bernard Morrey

DALLAS — DePuy and Johnson & Johnson have asked the judge overseeing the 4th bellwether Pinnacle hip trial to exclude or limit the testimony of plaintiffs’ expert Dr. Bernard Morrey, arguing that his Rule 26 report failed to disclose all of his opinions.

In an Oct. 11 brief filed before Judge Ed Kinkeade of the U.S. District Court for the Northern District of Texas, defendants maintain that “at the very least,” Dr. Morrey should be barred from offering opinions that were not disclosed in the report.
