Cordis Asks High Court to Review CAFA Joint Trial Ruling in IVC Filter Action

SAN FRANCISCO — Cordis Corp. has asked the U.S. Supreme Court to review a federal appeals court’s holding that plaintiffs’ request for consolidation of eight IVC filter actions does not constitute a request for a joint trial under the Class Action Fairness Act.

Cordis filed a petition for certiorari on Sept. 13, seeking to challenge the 9th Circuit U.S. Court of Appeals’ holding that CAFA jurisdiction cannot be established where the plaintiffs clearly state they are not seeking consolidation or bellwether trials for the purposes of a single trial to determine the outcome of common issues for all plaintiffs.
