Wash. Federal Judge Dismisses Zimmer M/L Hip Case; Allows Plaintiff to Amend

SEATTLE — A Washington state judge has dismissed without prejudice claims of failure to warn, design and manufacturing defect, and breach of warranty claims in a Zimmer M/L hip replacement device action, ruling that the claims were inadequately pled.

However, in the June 9 order, Judge James L. Robart of the U.S. District Court for the Western District of Washington granted the plaintiff leave to amend his complaint, noting that Zimmer Inc. will not be prejudiced because discovery has not yet begun.
