NexGen Knee Implant MDL Court Declines to Remand Remaining Cases; Indicates Intent to Hold 2 More Bellwether Trials

CHICAGO –– The federal court overseeing the NexGen Knee Implant multidistrict litigation docket has indicated its intent to try “at least” two more bellwether trials, rejecting plaintiff efforts to remand the remainder of the cases to the transferor courts.

According to a May 23 notification of docket entry, Hon. Rebecca R. Pallmeyer of the U.S. District Court for the Northern District of Illinois stated that it was her plan to “resolve any remaining common issues before remand, and expects to try at least two more bellwether trials (including, if possible, one of the 5950 cases and one femoral loosening case) …
