9th Circuit Reverses Award of Summary Judgment for Foster Wheeler in Asbestos Case

SAN FRANCISCO –– The 9th Circuit U.S. Court of Appeals has reversed an award of summary judgment entered in favor of Foster Wheeler, finding that the District Court erred when it found plaintiff expert testimony was speculative and inadmissible.
In its April 27 opinion, the 9th Circuit opined that the testimony of Charles Ay was based on “extensive experience with asbestos-containing materials in Naval ships.”
Geraldine Hilt filed the underlying asbestos-related claims on behalf of Robert Hilt. The plaintiff specifically alleged that Hilt was exposed to asbestos fibers from insulation supplied by Foster Wheeler.
