J&J Defendants Seek Protective Order in Delaware Talc Cases, Say Plaintiffs Have Served ‘Irrelevant, Harassing’ Discovery Requests

WILMINGTON, Del. –– Johnson & Johnson and Johnson & Johnson Consumer Inc. have moved for a protective order in a number of talcum powder cases pending in Delaware state court, maintaining that the plaintiffs have served upon them irrelevant, overbroad, harassing, and unduly burdensome discovery requests.

In the March 2 motion filed in the Delaware Superior Court, the Johnson & Johnson defendants argued that the plaintiffs are merely attempting to leverage an improper fishing expedition before the court weighs in on the defendants’ motion to dismiss for lack of personal jurisdiction.
