Utah Federal Judge Upholds Order Compelling Deposition Testimony on Reinsurance Agreements

SALT LAKE CITY — A Utah federal judge has upheld an order compelling an insolvent insurer to produce deposition testimony regarding reinsurance agreements, ruling that the magistrate judge correctly applied the appropriate legal standard.

In a Feb. 13 order, Judge Dale A. Kimball of the U.S. District Court for the District of Utah explained that in examining each category of evidence on which the directors and officers are seeking to obtain deposition testimony, Magistrate Judge Evelyn Furse considered whether the discovery was relevant and proportional, as the legal standard requires.
