Texas Federal Judge Remands Coverage Case, Says Claims Against Nondiverse Adjusters Adequately Pled

SAN ANTONIO, Texas — A Texas federal judge has remanded to state court a dispute over whether a hotel sustained covered damage from a “wind/hail” event, finding the hotel’s owner pled viable claims against the nondiverse adjuster defendants.
On Jan. 31, Judge Xavier Rodriquez of the U.S. District Court for the Western District of Texas found the plaintiff adequately alleged that the adjusters violated the Texas Insurance Act and the Deceptive Trade Practices Consumer Protection Act.
