6th Circuit Affirms Summary Judgment Award for GP; Says Asbestos Experts Failed to Quantify Exposure

CINCINNATI –– The 6th Circuit U.S. Court of Appeals has affirmed an awarded of summary judgment for Georgia-Pacific, finding that the plaintiff had failed to establish that the defendant’s products were a probable, as opposed to merely possible, cause of the decedent’s mesothelioma.

In the Jan. 10 opinion, the 6th Circuit pointed out that neither of the plaintiffs’ experts had quantified the extent of the decedent’s alleged exposure and, instead, had merely insisted that “every further exposure would have contributed to the development of his disease.”
