ST. LOUIS — A Missouri federal judge has remanded a Profemur hip replacement action filed against Wright Medical Technology Inc. and two distributors, ruling that diversity is lacking because the distributor defendants are Missouri residents.
On Sept. 27, Judge Ronnie L. White of the U.S. District Court for the Eastern District of Missouri held that the court’s earlier order allowing plaintiffs to amend their complaint to add the nondiverse defendants was not inadvertent and, as such, federal subject matter jurisdiction is lacking.
