C-8 MDL Court Rejects Plaintiff Requests for Protective Order on Discovery Regarding Expert

CINCINNATI –– The federal court overseeing the C-8 personal injury multidistrict litigation docket has refused to issue a protective order for discovery sought regarding a plaintiff expert, saying the efforts are better suited as a motion in limine.

In the Oct. 7 order, the U.S. District Court for the Southern District of Ohio said that the request for a protective order is moot since DuPont had already received the discovery it requested.

The court explained that plaintiffs in both of the bellwether trials used Robert Bahnson, M.D., as a specific causation expert.
