N.C. Court Denies Motion for Summary Judgment Filed by Union Carbide in Asbestos Case

CHARLOTTE, N.C. – A North Carolina federal court has refused to award Union Carbide summary judgment in an asbestos case, saying the conflicting evidence should be weighed by a jury.

In the Sept. 26 opinion, the U.S. District Court for the Eastern District of North Carolina found that the plaintiff had “proffered sufficient evidence to resist summary judgment on the claim that UC’s failure to warn Georgia-Pacific and U.S. Gypsum of the dangers of its Calidria product was a proximate cause of [the decedent’s] mesothelioma.”
