N.Y. Federal Judge Dismisses Superstorm Sandy Case for Failure to Prosecute

NEW YORK — A New York federal judge has dismissed a Superstorm Sandy case for failure to prosecute, noting that the plaintiff has taken no action to move his case forward since it was filed in 2014, thereby prejudicing the defendant insurer.

On Sept. 30, Senior Judge Denis Hurley of the U.S. District Court for the Eastern District of New York added that the plaintiff’s due process rights “have been adequately balanced against the need to alleviate court congestion.”
