Pennsylvania Federal Court Grants Lockheed Martin’s Motion to Dismiss, Says There is No Basis for Exercising Jurisdiction

PITTSBURGH – A Pennsylvania federal court has granted asbestos defendant Lockheed Martin’s motion to dismiss for lack of jurisdiction, opining that the defendant hadn’t registered to do business until at least 30 years after the alleged exposure occurred.

In the Sept. 16 order, the U.S. District Court for the Western District of Pennsylvania further ruled that it would not retain jurisdiction over the remaining state-law claims and remanded the case to Pennsylvania state court.

The underlying claims were asserted on behalf of Peter George, who allegedly developed mesothelioma as a result of exposure to asbestos-containing products. The decedent came into …
