JPML Refuses to Vacate Transfer Order, Says Durom Hip Cup Plaintiff Can Challenge Jurisdiction in MDL Court

WASHINGTON, D.C. –– The U.S. Judicial Panel on Multidistrict Litigation has declined to vacate a transfer order it issued in a complaint involving Zimmer’s Durom Hip Cup device, ruling that jurisdictional issues do not present “an impediment to transfer.”

In the Aug. 5 order, the JPML said that the parties can present their arguments relating to jurisdiction to the MDL Court.

The plaintiffs in Douglas asked the JPML to vacate the order transferring the claims for inclusion in the MDL for Zimmer Durom Hip Cup products liability claims, saying that the action was improperly removed. Additionally, the plaintiffs said, their …
