Imerys Talc America Moves to Dismiss Okla. Talc Claims for Lack of Personal Jurisdiction

OKLAHOMA CITY –– Imerys Talc America Inc. has moved to dismiss a talc-based powder exposure suit, saying that the court does not have personal jurisdiction over the company.
In the June 29 brief filed with the U.S. District Court for the Western District of Oklahoma, the defendant says that it is not subject to neither general nor specific jurisdiction in part because the plaintiffs have failed to establish how the defendant is “at home” in Oklahoma.
Further, the defendant argued, the plaintiffs’ claims do not arise from any in-state activities of Imerys.
