N.Y. Jury Awards $22 Million to Asbestos Plaintiff in Case Involving Burnham’s Boilers
June 27, 2016
NEW YORK –– A New York jury has awarded an asbestos plaintiff $22 million at the conclusion of a trial involving asbestos-containing external insulation on Burnham’s boilers, finding that the lone remaining defendant acted with recklessness.
The New York Supreme Court for New York County jury reached the verdict on June 24. Judge Martin Shulman presided over the trial.
Since the defendant was found to be reckless, Burnham will be held jointly and severally liable for the entire verdict, less set-offs, despite the fact that the jury only apportioned 25 percent liability to the defendant, sources told HarrisMartin.
