Plaintiffs Oppose Post-Trial Motions, Say Size of $502 Million Verdict Provides No Basis for New Trial

DALLAS –– Plaintiffs who were awarded $502 million at the conclusion of a pinnacle hip implant trial have opposed defendants’ post-trial motions, arguing that DePuy and Johnson & Johnson merely repeat arguments that were rejected in eight motions for mistrial.

In an April 21 brief filed in the U.S. District Court for the Northern District of Texas, the plaintiffs noted that the established rule in the court is to not to disturb a jury verdict for excessiveness “except for the strongest of showings.”
