Plaintiff Asserting Both DePuy ASR and Pinnacle Claims Asks Court to Reinstate Pinnacle Case

SAN FRANCISCO –– A plaintiff who was implanted with both DePuy’s ASR and Pinnacle hip implants has requested that his request for dismissal be vacated so that he can pursue claims related to the Pinnacle implant in the state’s separate coordinated docket.

In the April 11 motion filed in the California Superior Court for San Francisco County the plaintiff explained that while he attempted to take part in the global settlement agreement for ASR claims and retain his Pinnacle claims, his case was instead mistakenly dismissed in its entirety.
