Design Defect, Warning Claims Survive Wright’s Motion for Summary Judgment in Fla. Profemur Hip Action

TAMPA, Fla. — A Florida federal judge has denied Wright Medical Technology Inc.’s motion for summary judgment in a Profemur System hip replacement action, saying questions of fact exist as to whether the device was defectively designed and whether the plaintiff’s surgeon was adequately warned of the risks.
In a March 31 order, Judge John Antoon II of the U.S. District Court for the Middle District of Florida also refused to exclude the testimony of two plaintiffs’ engineering experts, finding they are qualified to testify as to the device’s susceptibility to corrosion and whether Wright conducted adequate testing.
