Ind. Federal Judge Dismisses St. Jude ICD Injury Case, Grants Plaintiff Time to Re-Plead Claims

TERRE HAUTE, Ind. — An Indiana federal judge has dismissed without prejudice an action alleging injuries caused by a St. Jude Medical Inc. implantable cardiac defibrillator, explaining that the plaintiff failed to specify how the device was defective.
In a March 21 order, Judge Larry J. McKinney of the U.S. District Court for the Southern District of Indiana further held that as pleaded, the plaintiffs claims are federally preempted because he failed to plead state law claims that parallel federal law.
