N.J. Federal Magistrate Judge Denies Motion to Seal MedWatch Forms in Benicar MDL

CAMDEN, N.J. — A New Jersey magistrate judge has denied without prejudice several defendant drug makers’ motion to seal MedWatch forms and other materials in the federal olmesartan multidistrict litigation, ruling that the companies failed to support their contention that the exhibits contained trade secrets or highly sensitive commercial information.

However, in the Jan. 21 order, Magistrate Judge Joel Schneider granted defendants leave to re-file their motion to seal, explaining that it must be supported by a competent certification or affidavit.

Approximately 1,200 plaintiffs have sued Daiichi Sankyo Inc., Daiichi Sankyo U.S. Holdings Inc., and Forest Laboratories Inc. alleging adverse …
