Wis. Appellate Court Reverses Award of Summary Judgment, Says Statute of Repose Doesn’t Bar Asbestos Claims

MILWAUKEE –– A Wisconsin appellate court has reversed an order granting motions for summary judgment, finding that the asbestos defendants had failed to establish that the alleged work completed by the decedent was an improvement to real property.
In the Dec. 22 opinion, the Wisconsin Court of Appeals, District I, found that “the fact that the projects were large, expensive, and involved is not enough” to support a finding that the statute of repose bars the claims.
