Miss. Federal Judge Dismisses Claims Against St. Jude in Spinal Cord Stimulator Action

JACKSON, Miss. — A Mississippi federal judge has dismissed with prejudice claims asserted against St. Jude Advanced Neuromodulation Systems Inc. in connection with its Eon Mini spinal cord stimulator, ruling that the plaintiff failed to state a cognizable claim and that any adequately-pled claim would be preempted.
In the Dec. 16 order, Judge Keith Starrett of the U.S. District Court for the Southern District of Mississippi also dismissed the claims against the plaintiff’s surgeon for lack of federal jurisdiction.
