Federal Judge Remands Zofran Case, Says Claims Against Nondiverse Defendants Arise from Same Occurrence

PIKEVILLE, Ky. — A Kentucky federal judge has remanded a Zofran case to state court, ruling that the claims against the nondiverse healthcare practitioners arise from the same occurrence and a question of law or fact common to all defendants will arise.

On Dec. 9, Judge Amul R. Thapar of the U.S. District Court for the Eastern District of Kentucky further held that the claims against the healthcare defendants should not be severed because it would prejudice the plaintiffs by requiring them to litigate the same issues in state and federal court.
