Durom MDL Court Denies Zimmer’s Bid for Hague Convention Rules in Swiss Discovery

NEWARK, N.J. — The magistrate judge overseeing discovery in the Zimmer (NYSE: ZMH) Durom Cup MDL in the U.S. District Court for the District of New Jersey has denied Zimmer’s motion to apply Hague Convention rules to the taking of evidence from Zimmer’s Swiss affiliate.

In ruling on a motion for protective order that has been pending since October, Magistrate Judge Madeline Cox Arleo on Feb. 8 also ordered that any disputed documents relating to Swiss discovery that were authorized by U.S. citizens within this country be produced pursuant to the Federal Rules of Civil Procedure, “even if such documents …
