MOBILE, Ala.-A federal judge dismissed three out of five claims against the manufacturer of Metabolife 356 in a products liability lawsuit ruling the allegations were subsumed under the Alabama Extended Manufacturer's Liability Doctrine (AEMLD). Lowe v. Metabolife International Inc., et al., No. 01-CV-0538-BH-M (S.D. Ala.).
The motion to dismiss the plaintiff's claim under the AEMLD and claims of fraudulent misrepresentation, suppression and concealment and deceit were denied in U.S. Senior District Judge William B. Hand's June 18 ruling.
T. Dewayne Lowe filed the lawsuit against the manufacturer of Metabolife 356 claiming the drug caused his wife's death in June 1999. …
