BENTON, Ill. - An Illinois federal judge has ordered the defendants in a Levaquin injury case to show cause why the case should not be remanded to state court for lack of federal subject matter jurisdiction. Baker v. Johnson & Johnson, No. 10-283 (S.D. Ill.).
On April 21, Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois found it "highly questionable" as to whether federal subject matter jurisdiction exists in this case under either 28 United States Code § 1331 or 28 U.S.C. § 1332
