BENTON, Ill. - An Illinois federal judge has remanded an Avandia personal injury action, ruling that there is a lack of complete diversity of citizenship. Aaron v. GlaxoSmithKline, No. 09-1071 (S.D. Ill.).
In an April 28 order, Judge J. Phil Gilbert of the U.S. District Court for the Southern District of Illinois held that the now-dissolved predecessor of the defendant, GlaxoSmithKline, is incorporated in Pennsylvania and four of the plaintiffs are Pennsylvania citizens. In Pennsylvania, a dissolved corporation may be sued, the judge explained.
