Judge Refuses to Certify Class in One-A-Day WeightSmart Case

LITTLE ROCK, Ark. - For the second time, an Arkansas federal judge has refused to certify a class of individuals who allege that Bayer Corp. fraudulently touted its One-A-Day WeightSmart vitamins as a metabolism booster. Thompson v. Bayer Corp., No. 07-00017 (E.D. Ark.).

On Aug. 6, Judge James M. Moody of the U.S. District Court for the Eastern District of Arkansas ruled that common issues of law and fact do not predominate over issues particular to each buyer of the supplement.
