Prempro MDL Court Certifies, Forwards Statute of Limitations Question




LITTLE ROCK, Ark. - The judge overseeing the Prempro MDL has certified a question to the Minnesotha Supreme Court, asking it to determine whether the state's statute of limitations should be applied to certain claims filed on behalf of out-of-state plaintiffs. Fleeger v. Wyeth, et al., No. 07-506 (E.D. Ark.).

The question was certified by order Dec. 1, despite efforts by the plaintiffs to prevent the state Supreme Court from considering the issue, which they said was resolved by the state legislature years ago.
