MDL Court Retains W. Va. Attorney General's Suit Against Lilly

BROOKLYN, N.Y. - A New York federal judge has refused to remand a Zyprexa lawsuit brought by the West Virginia attorney general against Eli Lilly & Co., ruling that for the sake of uniformity, the multidistrict litigation court should continue to preside over discovery. State of West Virginia ex rel. McGraw v. Eli Lilly & Co., No. 06-5826 (E.D. N.Y.).

In a Sept. 30 order, Senior Judge Jack B. Weinstein of the U.S. District Court for the Eastern District of New York ruled that the case "continues to include statutory claims that can be appropriately determined" by the MDL court.
