MDL Court Issues New Order for Previously Tolled Claims

CLEVELAND - The 11,800 potential plaintiffs in the federal MDL who have been subject to a joint tolling agreement were addressed in a Dec. 5 order by the presiding judge, who explained their new obligations in the wake of defendants' decision to terminate the agreement. In Re: Welding Fume Products Liability Litigation, No. 1:03-CV-17000 (N.D. Ohio).
Defendants notified plaintiffs on Aug. 19 that they intended to end the tolling agreement as of Dec. 17, which makes those plaintiffs subject to deadlines for filing new or renewed complaints and complying with any relevant court orders.
