JACKSON, Miss. - Defendants appealing a ruling that allowed a sandblaster's former girlfriend to file a wrongful death complaint are taking issue with what they call an eleventh hour legal effort to designate the plaintiff as decedent's common law wife. Pangborn Corp., et al. v. Kelley, No. 2008-M-01437-SCT (Miss. Sup. Ct.).
Clark Sand Co. Inc., Clemco Industries and P.K. Linsay Co. on Nov. 19 responded to a motion to dismiss their appeal, claiming that the plaintiff's relationship with the decedent has already been established by lower courts and by plaintiff's own testimony.
