Court Says Pulmosan Link to Texas Insufficient for Injury That Occurred in La.

HOUSTON - A Texas appeals court has ruled that the state's MDL court does not have specific jurisdiction over a dissolved defendant accused of causing a sandblaster's silica-related injury in Louisiana. Moore v. Pulmosan Safety Equipment Corp., No. 14-07-00885-CV (Texas 14th Ct. App.).
Determining that the New York-based defendant did not waive its special appearance in the case, the Fourteenth Court of Appeals held on Dec. 9 that Pulmosan Safety Equipment Co.'s contacts with Texas and with plaintiff John Moore's claims were not substantial enough to warrant the court's jurisdiction over the defendant.
