TROY, Mich. - A Michigan appellate court has affirmed dismissal of autoworkers' claims against General Motors and makers of metalworking fluids, but said the trial court reached the right decision for the wrong reason. Bearup, et al. v. General Motors Corp., et al., No. 272654 (Mich. Ct. App.).
In an unpublished majority opinion released on Oct. 23, the Michigan Court of Appeals said the trial court erred in dismissing on statute of limitations grounds, but also erred in denying dismissal on sophisticated user grounds.
